Terms of Service

Welcome to the DICOM Library free online file sharing service. Please read these Terms of Service carefully before using this DICOM Library service. DICOM files and DICOM file Tags listed in these Terms of Service will be automatically anonymized in the user's browser before uploading to the DICOM Library server. The user who uploads data is responsible for uploaded data and can upload DICOM files WITHOUT PERSONAL DATA located ON PICTURE, ON VIDEO, IN DICOM SR TEXT, IN DICOM PDF's or in any other Tags not listed as automatically anonymized.

I. Your Acceptance

By using or visiting the DICOM Library website or any DICOM Library products and services, that are provided on the DICOM Library website (the "Service"), you agree to follow:

  • These terms and conditions (the "Terms of Service"),
  • DICOM Library's privacy policy, which can be found here and incorporated herein by reference.

If you do not agree to any of these terms of service or privacy policy, please do not use the Service.

We recommend to periodically review the most up-to-date version of the terms of service.

We reserve the right, at our sole discretion, to change, add, or delete portions of these terms of service at any time.

Nothing in these Terms of Service shall be deemed to confer any third-party rights or benefits.

II. Description of Service

  1. These Terms of Service apply to all users of the Service, including users who are also contributors of Content on the Service. Content includes all information and data provided in stored DICOM files (including the text, software, various scripts, graphics, photos, sounds, music, videos, audiovisual combinations or interactive features) and other materials you may view on, access through, or contribute to the Service. The Service includes all aspects of DICOM Library, including but not limited to all products, software and services offered via the DICOM Library website, such as the DICOM Library channels, the DICOM Library "Embeddable Viewer", the DICOM Library "Uploader" and other applications.
  2. There may be links to third party websites that are not owned or controlled by DICOM Library. DICOM Library has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third party websites.
  3. All services provided by DICOM Library are free-of-charge. However, DICOM Library may offer services, which considerably increase the performance and comfort, for a charge.
  4. The DICOM Library renders web hosting services for its users based on the following provisions

  5. A. PREFACE

    DICOM Library allows its users to upload DICOM files to DICOM Library servers. After saving the uploaded files, the user gets:
    • a "Management" link through which the uploaded file can be managed,
    • a "Download" link through which the file can be downloaded,
    • a "View" link, which allows to view files over the internet,
    • and a "Delete" link, which allows the user to remove the uploaded file from the server.

    B. UPLOAD RULES

    Users are permitted to upload only DICOM files WITHOUT PERSONAL DATA located ON PICTURE, ON VIDEO, IN DICOM SR TEXT, IN DICOM PDF's or in any other Tags not listed as automatically anonymized to DICOM Library servers. Uploaded information and data may be used only for reviewing, research or teaching.

    Before uploading files, DICOM Library provides DICOM tags Anonymity. It means that DICOM files are anonymized before they are uploaded, so DICOM Library servers do not receive this private information.

    DICOM Library Anonymity service allows the users to NOT distribute Patient, Institution and Physicians private information that is usually stored within the DICOM file. However, private information may be stored in other Tags and/or in the Image or Video content of the DICOM file. Therefore, a user always remains responsible for the information s/he distributes.

    We do not guarantee that all Tags will be entirely anonymous. If a user finds some anonymity issues (e.g. finds any private information) in any file, which is located in DICOM Library, s/he must immediately contact the Data Protection Officer dpo@dicomlibrary.vet.

III. General Use of the Service. Permissions and Restrictions

By using the DICOM Library service, you agree NOT to do any of the following:

  1. Post, distribute any part of the Service or the Content without DICOM Library's prior written authorization, unless DICOM Library makes available the means for such distribution through functionality offered by the Service (such as the Embeddable Viewer).
  2. Alter or modify any part of the Service.
  3. Access Content through any technology or means other than the video playback pages of the Service itself, the Embeddable Viewer, or other explicitly authorized means DICOM Library may designate.
  4. Use any automated system (such as bots, offline readers, etc.) that accesses the Service and sends more request messages to the DICOM Library servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser.
  5. Collect any personal information, including usernames, from the Service. You may not use the communication systems provided by the Service (e.g., comments, email addresses) for any commercial solicitation purposes.
  6. Use the Service for any of the following commercial uses unless you obtain DICOM Library's prior written approval:
    • the sale of access to the Service,
    • the sale of advertising, sponsorships, or promotions placed on or within the Service or Content,
    • or the sale of advertising, sponsorships, or promotions on any page of an ad- enabled blog or website containing Content delivered via the Service, unless other material not obtained from DICOM Library appears on the same page and is of sufficient value to be the basis for such sales.

    Prohibited commercial uses do not include uploading the DICOM files to DICOM Library, to use them for such objectives as science, teaching or learning.

  7. If you use the Embeddable Viewer on your web page, you may not modify, build upon, or block any portion of the Embeddable Viewer. The links back to the DICOM Library website may remain as well.

In your Use of the Service, you will comply with all applicable laws. DICOM Library reserves the right to change or discontinue any of the Services at any time.

IV. Use of Content

In addition to the general restrictions above, the following conditions apply specifically to your Use of Content.

  1. The Content on the Service are owned by or licensed to DICOM Library, subject to copyright and other intellectual property rights under the law. The same applies to the trademarks, service marks and logos ("Marks") on the Service.
  2. Content is provided to you AS IS. You may access Content for your information and personal use solely as intended through the provided functionality of the Service and as permitted under these Terms of Service. You shall not download any Content unless you see a "Download", "View" or similar link displayed by DICOM Library on the Service for that Content. You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written agreement of DICOM Library or the respective licensors of the Content. DICOM Library and its licensors reserve all rights not expressly granted in and to the Service and the Content.
  3. You agree not to circumvent, disable or otherwise interfere with security-related features of the Service or features that prevent or restrict use or copying of any Content or enforce limitations on use of the Service or the Content therein.
  4. You understand that when using the Service, you will be exposed to Content from a variety of sources, and that DICOM Library is not responsible for the accuracy, usefulness, safety, or intellectual property rights of such Content. Moreover, you acknowledge that you may be exposed to Content that is inaccurate, indecent, offensive, or objectionable, and you agree to waive any legal or equitable rights or remedies you have or may have against DICOM Library. Also, you agree to indemnify and hold harmless DICOM Library, its owners, operators, affiliates, licensors, and licensees to the fullest extent allowed by law regarding all matters related to your use of the Service.

V. Your Content and Conduct

  1. As a DICOM Library user you may submit Content to the Service. You understand and acknowledge that DICOM Library does not guarantee any confidentiality with respect to any Content you submit.
  2. You shall be completely responsible for your own Content and the consequences of submitting and publishing your Content on the Service. You affirm, represent, and warrant that you own or have the necessary licenses, rights, consents, and permissions to publish Content you submit. You license to DICOM Library all patent, trademark, trade secret, copyright or other proprietary rights in and to such Content for publication on the Service pursuant to these Terms of Service.
  3. You agree that Content you submit to the Service will not contain third party copyrighted material, or material that is subject to other third party proprietary rights, unless you have permission from the third parties.
  4. DICOM Library does not endorse or supports any Content submitted to the Service by any user or other licensor, as well as any opinion, recommendation, or advice expressed therein. DICOM Library expressly disclaims all liability in connection with Content. DICOM Library does not permit copyright infringing activities and infringement of intellectual property rights on the Service, and DICOM Library will remove all Content if properly notified that such Content infringes on another intellectual property rights.
  5. DICOM Library reserves the rights to remove or replace any uploaded files that are unlawful, that may compromise the security of the servers, that are using excessive bandwidth, that have not been in active use the past 60 calendar days or when deemed necessary without prior notice.

VI. Account Termination Policy

  1. DICOM Library will terminate a user's access to the Service if, under appropriate circumstances, the user is determined to violate the DICOM Library's rules and policy.
  2. DICOM Library reserves the right to decide whether Content violates these Terms of Service for reasons other than copyright infringement, such as pornography, obscenity, or excessive length, etc. DICOM Library may at any time, without prior notice and in its sole discretion, remove such Content and/or terminate a user's account for submitting such material in violation of these Terms of Service.

VII. Warranty Disclaimer

  1. You must bear the risks associated with the use of the site. The site and the services offered through this site are provided without any warranties or guarantees and in an "as is" condition.
  2. DICOM Library, its subsidiaries, affiliates, officers, directors, employees, agents, partners and licensors expressly disclaim all warranties and conditions, expressed or implied of any kind, regarding any matter pertaining to any use of the services. DICOM Library assumes no liability or responsibility for any errors, mistakes, or inaccuracies of content, as well as personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our services.
  3. DICOM Library assumes no responsibility for any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, any interruption or cessation of transmission to or from our services, any bugs, viruses, trojans, or similar malware which may be transmitted to or through our services by any third party, and/or any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available via the services.
  4. DICOM Library does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the services or any hyperlinked services or featured in any banner or other advertising, and DICOM Library will not be a party to or in any way be responsible for monitoring any transaction between you and third-party providers of products or services. As with the purchase of a product or service through any medium or in any environment, you should use your best judgment and exercise caution where appropriate.

VIII. Limitation of Liability

  1. DICOM Library, its partners, affiliates, officers, directors, employees, or agents, shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages or loss of profits, use, data or other intangible losses arising out of or in connection with DICOM Library, it's services or this term of use.
  2. Under no circumstances will company be held responsible or liable, in any way, for any content which in legal opinion is derogatory, threatening, defamatory, obscene or offensive or offends public sensibilities or morals and shall also not assume liability for any errors or omissions in any content, or for any loss or damage of any kind incurred as a result of the use of any content posted or uploaded on the site, or any infringement of another rights, including intellectual property rights. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.
  3. You agree and acknowledge that DICOM Library is not responsible for any content sent using and/or included in DICOM Library site/service by any third party.
  4. You acknowledge that the service may be unavailable during the routine maintenance or upgrades. Moreover, you agree that DICOM Library is dependent upon networks, internet service providers and other third parties, which are not under control of our company.
  5. Therefore, you agree that the company shall not be in breach of any of its obligations or held liable for any lack of service quality and the non-availability of the service, or consequences arising there from.
  6. The Service is controlled and offered by DICOM Library from its facilities in Lithuania. DICOM Library makes no representations that the Service is appropriate or available for use in other countries. Those who access or use the Service from other jurisdictions do so at their own volition and are responsible for compliance with local law.

IX. Ability to Accept Terms of Service

  1. You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service.
  2. If, for any reasons, you do not understand how to use the Service or do not accept the Terms of Service, please do not use the Service.
  3. In any case, you affirm that you are over the age of 13, as the Service is not intended for children under 13. If you are under 13 years of age, then please do not use the Service.

X. General

DICOM Library reserves the right to change these Terms of Service at any time and without notice, and it is your responsibility to review these Terms of Service for any changes. Your use of the Service following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms.
